    Tailvision Acceptable Use Policy


    TAILVISION ACCEPTABLE USE POLICY

    This Acceptable Use Policy ("AUP") (as may be modified from time to time) is a legal agreement between you ("User," "You," "Your") and JETNET L.L.C. and/or its Affiliates ("Company") governing your use of the Tailvision mobile application (the "App").

    By downloading, installing, or using the App, you agree that your use is expressly conditioned on your acceptance of, and compliance with, this AUP. If Company determines that you do not meet the requirements of this AUP or have violated it, Company may refuse to provide the App to you, or may suspend, restrict, or terminate your access at any time, in its sole discretion.

    1. DEFINITIONS.

    “App” means the Tailvision mobile application published by Company, and any related content, features, and updates.

    “Aircraft Data” means flight-tracking information, including ADS-B-derived position, identification, and related data, displayed through the App.

    “Malicious Code” means harmful or malicious code, files, scripts, agents, or programs designed or intended to disrupt, disable, harm, corrupt, or provide unauthorized access to a computer system, database, network, or device, including but not limited to viruses, worms, time bombs, and Trojan horses.

    “Platform” means a third-party application marketplace through which the App is distributed, including Apple, Inc.’s App Store and Google LLC’s Google Play Store.

    2. ELIGIBILITY.

    To use the App, you must be at least 13 years old. If you are under the age of 18 (or the age of majority in your jurisdiction), you represent that you have your parent or legal guardian’s permission to use the App and that they have reviewed and agreed to this AUP on your behalf. Company may verify eligibility and may refuse, suspend, or terminate access to any user it reasonably believes does not meet these requirements.

    3. LICENSE GRANT AND OWNERSHIP.

    a. License Grant. Subject to your compliance with this AUP, Company grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on devices you own or control, solely for your own personal, non-commercial use.

    b. Ownership. The App, and all intellectual property rights therein — including all software, design, text, graphics, the Tailvision name and logo, Aircraft Data as compiled, processed, and made available by Company, and all other content made available through the App — are and will remain the exclusive property of Company and its licensors. No rights are granted to you other than the limited license expressly set forth in this AUP, and Company reserves all rights not expressly granted.

    c. Termination of License. This license terminates automatically, without notice, if you breach this AUP, or upon Company’s suspension or termination of your access under Section 9. Upon termination, you must immediately stop using the App and delete all copies of it from your devices.

    d. No Assignment. Your license under this AUP is personal to you and may not be assigned, transferred, or sublicensed, in whole or in part, to any third party.

    e. Indemnification. You agree to indemnify and hold Company harmless from any claims, damages, or liabilities arising out of your breach of this AUP or your misuse of the App or Aircraft Data.

    4. USER OBLIGATIONS.

    a. Use the App only for lawful, personal, non-commercial purposes;

    b. Use commercially reasonable care to prevent unauthorized access to your device or account credentials, and promptly notify Company of any known unauthorized access or use;

    c. Ensure that your device, connection, and any third-party software used with the App do not interfere with or disrupt the App’s integrity, security, or performance; and

    d. Comply with all applicable laws in your use of the App, including aviation, privacy, and data protection laws.

    5. RESTRICTIONS ON USE.

    Except where prohibited by applicable law, you shall not, and shall not permit or assist any third party to, directly or indirectly:

    a. Reverse engineer, disassemble, or decompile any component of the App;

    b. Scrape, bulk-extract, systematically download, or programmatically query Aircraft Data or other App content, including through automation, scripts, bots, or unauthorized use of any API;

    c. Publish, resell, sublicense, transmit, broadcast, or redistribute the App or Aircraft Data obtained through it to any third party, or incorporate it into any other product, service, or database;

    d. Use the App to build or support a product or service that competes with the App or Company’s other offerings;

    e. Modify, copy, or create derivative works based on the App;

    f. Remove or obscure any proprietary notices displayed in or on the App;

    g. Use the App in any way that infringes the intellectual property or other rights of a third party; or

    h. Use the App in any manner that materially interferes with, degrades, or overburdens Company’s systems or negatively impacts other users.

    6. AIRCRAFT DATA DISPLAY; NO NAVIGATION USE.

    Aircraft Data displayed through the App is provided for informational and entertainment purposes only. The App and Aircraft Data are NOT intended for, and must not be used for, navigation, air traffic control, collision avoidance, or any other safety-of-flight purpose. Aircraft Data may be delayed, incomplete, or inaccurate. Company has no obligation to display data for such aircraft. To the maximum extent permitted by law, Company disclaims all liability arising from reliance on Aircraft Data for any safety-related decision.

    7. DATA SOURCING AND ACCURACY.

    Aircraft Data is derived from publicly broadcast flight-tracking transmissions collected and compiled through Company’s own network of ADS-B receivers and feeders. Company does not guarantee the completeness, accuracy, or timeliness of any Aircraft Data displayed.

    8. DEVICE PERMISSIONS.

    The App may request access to your device’s camera, location, and motion or orientation sensors in order to identify and display information about nearby or surrounding aircraft. Company will use such access only for the purposes disclosed in the App and Company’s Privacy Notice. You may decline or later revoke these permissions through your device settings, though doing so may limit or disable core App functionality.

    9. COMPANY’S RIGHTS.

    a. Monitoring. Company reserves the right to monitor use of the App at any time, without notice, to ensure compliance with this AUP.

    b. Rate Limiting. Company may throttle, limit, suspend, or terminate access to the App, or any account, if usage is determined, in Company’s sole discretion, to be excessive, automated, or otherwise inconsistent with normal individual use.

    c. Suspension or Termination. Company may suspend or terminate your access to the App for any actual or suspected violation of this AUP, at any time and without liability to you.

    10. THIRD-PARTY APPLICATION PLATFORMS.

    Because the App is distributed through a Platform, the following additional terms apply: (a) this AUP is an agreement between you and Company only, and not with the Platform provider; (b) the Platform provider has no obligation to furnish any maintenance or support services for the App; (c) in the event of any failure of the App to conform to any applicable warranty, you may notify the Platform provider, which may, to the extent required by its own terms, refund the purchase price, if any, for the App, and, to the maximum extent permitted by law, the Platform provider will have no other warranty obligation with respect to the App; (d) the Platform provider is not responsible for addressing any claims relating to the App or your possession or use of it, including product liability claims, claims that the App fails to conform to legal or regulatory requirements, and consumer protection or similar claims; (e) the Platform provider is not responsible for the investigation, defense, settlement, or discharge of any claim that the App infringes a third party’s intellectual property rights; (f) you represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and are not listed on any U.S. Government list of prohibited or restricted parties; and (g) the Platform provider, and its subsidiaries, are third-party beneficiaries of this AUP and may enforce it against you.

    11. COMPLIANCE WITH LAWS.

    You agree to comply with all applicable laws in connection with your use of the App, and you are solely responsible for ensuring your continued compliance, including any export control, aviation, or data protection laws applicable in your jurisdiction.

    12. PRIVACY NOTICE.

    Your use of the App is also subject to Company’s Privacy Notice, which governs Company’s Services generally and describes the personal data collected through the App, including device permissions data, and how it is used.

    13. CHANGES TO THIS AUP.

    Company may modify this AUP at any time by posting an updated version through the App or Company’s website. Continued use of the App after an update constitutes acceptance of the revised AUP.
